Pay-As-You-Go Terms and Conditions

TERMS & CONDITIONS

When you sign up for New York Theatre Workshop (“NYTW”)’s Pay As You Go Membership (“Membership”), you agree to these Terms. By agreeing to these Terms, you represent that you are at least eighteen years old and capable of entering into a legally binding agreement.

Your Membership may not be combined with other programs, promotions, or offers. Membership may only be used by the primary Membership holder, is not transferrable, and cannot be resold. Limit one Membership per person.

BENEFITS

Open exclusively to new Members, the Pay As You Go Membership entitles the holder to one ticket to each of the following five productions: WHAT THE CONSTITUTION MEANS TO ME, SLAVE PLAY, HURRICANE DIANE, SANCTUARY CITY, and a new work by ANNA DEAVERE SMITH. In the event of a cancellation, alternate productions may be substituted at the discretion of NYTW. Your Member ticket must be booked during the Preview Period of each production. The Preview Period begins on the third performance and concludes on the performance prior to the Opening Night performance. If you are unable to attend during the Preview Period, you may apply the value of your ticket ($35) to a future performance of the same production and pay the difference in the price of the ticket when you book. If you need to change the date of your performance, you may exchange your ticket for another performance in the Preview Period, subject to an $8 per ticket exchange fee. If you are unable to use your Member ticket for a production, you may donate it to NYTW as a tax-deductible donation. Membership does not include productions in the Next Door at NYTW series, fundraising events, or special programming. Members are granted advance access to book tickets prior to the public on-sale of each production. NYTW is not liable for unused Benefits or additional fees if you are unable to book your ticket during the Preview Period of a production. You consent to a Membership through July of 2019 unless you cancel your Membership or NYTW terminates it.

COMMUNICATION PREFERENCES

By signing up as a Member, you consent to receive electronic communications from NYTW relating to your Membership and waive rights to receive any postal mailings. You must have and maintain a valid email address and provide a current, valid credit card as your Method of Payment to use the Benefits of this Membership. A phone number and billing address will also be required to complete your account setup. NYTW is not liable for the loss of Benefits if you unsubscribe from electronic communications or if your Method of Payment is invalid or expired.

RECURRING BILLING CYCLE

The Annual Fee ($25) and first Monthly Membership Payment ($15) will be billed at the time of purchase. You authorize NYTW to bill your Method of Payment for subsequent Monthly Membership Payments on the first business day of each month through July 2019. NYTW reserves the right to change the billing schedule without notice, in particular if your Method of Payment expires or is declined. In the absence of a successful Monthly Membership Payment, your Benefits may be frozen or your Membership may be terminated by NYTW.

METHOD OF PAYMENT

You may update or change your Method of Payment by calling 212-460-5475. If a Monthly Membership Payment is not successfully completed, due to expiration, insufficient funds, or otherwise, and you do not update your Method of Payment or cancel your Membership, you remain responsible for any uncollected Monthly Membership Payments and authorize NYTW to cancel existing and future Benefits until you remit full payment. NYTW is not liable for any foreign transaction fees or other charges incurred by your Method of Payment.

CANCELLATION

You may cancel your Membership at any time, subject to a cancellation fee of $45. Upon cancellation, you forfeit any future Benefits. Cancelled Memberships cannot be re-activated until the following membership renewal period, subject to availability.

MEMBERSHIP SUSPENSION, TERMINATION, OR ALTERATION

NYTW may suspend or terminate your Membership in accordance with these Terms. For example, we may suspend or terminate your account if there is a late payment, suspected fraud, or we determine there is a violation of these Terms. If your Membership is terminated or suspended, you will immediately lose access to your Benefits. NYTW reserves the right to add or remove Benefits at any time without notice.

FINAL SALE

ALL CHARGES ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR UNUSED OR PARTIALLY USED BENEFITS. At any time, and for any reason, NYTW may provide a refund, discount, or other consideration to some or all Members (“Credits”). The amount and form of such Credits, and the decision to provide them, are at NYTW’s sole and absolute discretion. The provision of Credits in one instance does not entitle you to Credits in the future, nor does it obligate NYTW to provide credits in the future, under any circumstance.
